1. Acceptance of Terms

By accessing or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services or make purchases from Sweet Express.

2. Products and Services

2.1 Product Descriptions

Sweet Express specializes in creating memorable desserts for celebrations including cakes, cake pops, cake push pops, cake shooters, and custom themed creations. We strive to provide accurate descriptions and images of our products. However, we do not warrant that product descriptions, images, or other content are accurate, complete, reliable, current, or error-free. Products may vary slightly in appearance from images due to the handmade, made-to-order nature of our items.

2.2 Fresh, Made-to-Order Quality

All Sweet Express products are made from scratch using real, fresh ingredients with no shortcuts. Each order is custom-prepared for your specific event. This commitment to quality means our products require advance ordering time and cannot be rushed without potentially compromising quality.

2.3 Availability

All products are subject to availability and our production capacity. We reserve the right to limit quantities or decline orders based on our schedule and resources. In the event that we cannot fulfill your order as requested, we will notify you promptly and provide a full refund or work with you to find a suitable alternative.

2.4 Allergen Information

Our products may contain or come into contact with common allergens including but not limited to: milk, eggs, wheat, soy, peanuts, tree nuts, and other ingredients. Please review product descriptions carefully and contact us if you have specific allergy concerns. While we take precautions, we cannot guarantee that our products are completely free from allergens due to potential cross-contamination in our kitchen. We are not liable for allergic reactions resulting from consumption of our products.

3. Orders and Payment

3.1 Order Acceptance

Your order constitutes an offer to purchase products from Sweet Express. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, production capacity, delivery location restrictions, errors in pricing or product information, or suspected fraudulent activity. You will receive an order confirmation email once your order has been accepted.

3.2 Pricing and Payment

All prices are listed in U.S. dollars and are subject to change without notice. Payment is required at the time of order placement unless otherwise arranged. We accept major credit cards, debit cards, and other payment methods as indicated on our website or communicated during the ordering process. You agree to provide current, complete, and accurate payment information.

3.3 Custom and Themed Orders

Custom and themed orders (including specialty cakes, themed cake pops, push pops, and shooters) require advance notice and may require a deposit. Specific lead times will be communicated at the time of order based on design complexity and our current schedule. Custom orders are final and non-refundable once production has begun, except in cases where we fail to meet the agreed specifications.

3.4 Minimum Order Requirements

Certain products, particularly for events such as weddings, birthdays, baby showers, and graduations, may have minimum order quantities. These requirements will be clearly communicated during the ordering process.

4. Delivery

4.1 Delivery Service Area

Sweet Express provides delivery services exclusively to customers located within Indianapolis, Indiana. We do not offer pickup services or delivery outside of Indianapolis, Indiana at this time. By placing an order, you confirm that your delivery address is within Hamilton County, Indiana. Orders placed with delivery addresses outside of Indianapolis, Indiana will be declined.

4.2 Products Available for Delivery

We offer delivery for cakes, cake pops, cake push pops, and cake shooters. Full-size cakes are not available for shipping and must be arranged through alternative means. Please contact us directly if you have questions about specific products available for delivery.

4.3 Delivery Schedule and Fees

Delivery fees and available delivery dates will be communicated at the time of order based on your location within Indianapolis, Indiana and order size. Orders can either be delivered to your Indianapolis, Indiana location or picked up at a mutually agreed upon meeting location within Indianapolis, Indiana. We will make reasonable efforts to deliver products at the requested time, but we are not liable for delays caused by circumstances beyond our control, including weather, traffic, venue access issues, or other unforeseen events.

4.4 Delivery Acceptance

You or your designated recipient must be available to accept delivery at the specified address and time. If no one is available to accept the delivery, we will attempt to contact you using the contact information provided. If we are unable to complete the delivery due to recipient unavailability or incorrect address information, the order may be cancelled without refund, or additional delivery fees may apply for redelivery attempts.

4.5 Inspection Upon Delivery

Please inspect your order immediately upon delivery and report any issues to our delivery personnel or contact us within 2 hours of delivery with photos and a detailed description. Once you accept delivery, you assume all responsibility for the condition and handling of the products.

4.6 Product Care & Storage

Our baked goods are made fresh with quality ingredients and should be stored properly to maintain optimal freshness and flavor. Products should be refrigerated upon receipt and will stay fresh for up to 2 weeks when properly stored in the refrigerator in an airtight container. For longer storage, items can be frozen for up to 3 months - simply wrap tightly in plastic wrap or place in a freezer-safe container. When ready to enjoy, thaw frozen items in the refrigerator overnight or at room temperature for 1-2 hours. For best taste and texture, allow refrigerated items to come to room temperature for 15-30 minutes before serving.

4.7 Portable Formats

Our cake pops, push pops, and shooters are designed as mess-free, portable formats perfect for gatherings. However, proper handling and storage after delivery are still required to maintain their appearance and quality.

5. Cancellations and Refunds

5.1 Cancellation Policy

Standard orders may be cancelled up to 48 hours before the scheduled delivery time for a full refund. Custom and themed orders require at least 72 hours notice (or longer for complex designs) for cancellation. Cancellations made after these deadlines may be subject to a cancellation fee or forfeiture of deposit. Orders for which production has already begun cannot be cancelled and are non-refundable.

5.2 Refunds and Replacements

Due to the perishable, made-to-order nature of our products, we do not offer refunds once products have been delivered, except in cases of product defects, significant errors on our part, or failure to meet agreed specifications. If you believe there is an issue with your order, please contact us immediately upon delivery (within 2 hours) with photos and a detailed description. We will assess the situation and may offer a refund, replacement, or credit at our sole discretion.

5.3 Event Cancellations and Postponements

If your event (wedding, birthday, baby shower, graduation, etc.) is cancelled or postponed, please notify us as soon as possible. We will work with you in good faith to reschedule your order when feasible, subject to availability and our production schedule. However, refunds for event cancellations or postponements will be subject to our standard cancellation policy and timeline outlined above.

6. Intellectual Property

All content on our website and marketing materials, including but not limited to text, graphics, logos, images, product designs, and descriptions, is the property of Sweet Express and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

Custom designs and themed creations created by Sweet Express for your order remain our intellectual property. While you may share photos of your purchased products on social media and for personal use (and we encourage you to do so!), you may not use our designs for commercial purposes, claim them as your own work, or reproduce them without permission.

7. Limitation of Liability

To the fullest extent permitted by law, Sweet Express shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or event disruption, arising out of or related to your use of our products or services, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising out of or related to these Terms or your use of our products shall not exceed the amount you paid for the specific product giving rise to the claim. This limitation applies to all causes of action in the aggregate, including breach of contract, breach of warranty, negligence, and other tort claims.

We are not responsible for events beyond our reasonable control (force majeure), including but not limited to natural disasters, power outages, equipment failure, ingredient shortages, labor disputes, supply chain disruptions, pandemics, or government restrictions that may affect our ability to fulfill orders.

8. Indemnification

You agree to indemnify, defend, and hold harmless Sweet Express, its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of our products or services; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) allergic reactions, illness, or injury resulting from consumption of our products after delivery, provided such issues are not caused by our negligence.

9. Health and Safety

All Sweet Express products are made fresh from scratch using real ingredients in accordance with Indiana food safety regulations and health department requirements. We maintain strict food safety and hygiene standards throughout our preparation process. However, our products are prepared in a kitchen facility that handles common allergens including milk, eggs, wheat, soy, peanuts, tree nuts, and other ingredients.

It is your responsibility to inform us of any allergies or dietary restrictions at the time of ordering. While we make every reasonable effort to accommodate special dietary needs when possible, we cannot guarantee that our products are completely free from allergens due to potential cross-contamination during preparation, even with thorough cleaning procedures. Consumption of our products is at your own risk.

Our products contain perishable ingredients and must be stored, handled, and consumed properly according to the care instructions provided. We are not responsible for illness, adverse reactions, or food safety issues resulting from improper storage, handling, or consumption of our products after delivery.

10. Photography and Marketing

By placing an order with Sweet Express, you grant us permission to photograph your finished products and use those images for marketing purposes, including on our website, social media platforms, promotional materials, and advertising. These photographs help us showcase our work and attract new customers. If you do not wish for your order to be photographed or used in our marketing, please inform us in writing at the time of ordering, and we will respect your wishes.

We love when customers share photos of our products at their celebrations on social media! We actively encourage you to tag Sweet Express in your posts so we can celebrate your special moments with you and share in the memories we helped create. By tagging Sweet Express or using our designated hashtags, you grant us permission to repost or share your photos on our platforms with appropriate credit to you.

11. User Conduct

When using our website, services, or interacting with Sweet Express, you agree not to: (a) provide false, inaccurate, or misleading information; (b) use our services for any unlawful purpose or in violation of these Terms; (c) interfere with or disrupt our website, servers, or business operations; (d) attempt to gain unauthorized access to our systems or data; (e) collect or harvest information about other users; (f) engage in any conduct that could damage our reputation, business, or goodwill; or (g) make threatening, harassing, or abusive communications to our staff.

12. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information, including contact details, payment information, delivery addresses, and event details. By using our services and providing your information, you consent to our collection and use of your data as described in the Privacy Policy. We are committed to protecting your privacy and will not sell your personal information to third parties.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically. The "Last Updated" date at the top of this document indicates when these Terms were last revised.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or your use of our services shall be resolved in the state or federal courts located in Hamilton County, Indiana, and you consent to the exclusive jurisdiction and venue of such courts.

Before filing any lawsuit, both parties agree to attempt to resolve disputes through informal negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue formal legal remedies.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Sweet Express regarding your use of our services and supersede all prior agreements, communications, and understandings, whether written or oral.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of Sweet Express.

18. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms to any affiliate, successor, or purchaser of our business without restriction.
